This Privacy Policy (this "Policy") describes the practices of La plateforme de location inc., operating under the brand name Loopa ("Loopa," "we," "us," or "our"), for collecting, using, maintaining, disclosing, and otherwise processing (collectively, "Processing") information we collect from you through the Loopa application, website, and related services (collectively, the "Services"). This Policy also explains how we protect your data and what rights you have over it.

This Policy is subordinate to any specific terms set forth in any terms of use or other agreements you may have with Loopa relating to a particular product or service.

1.What information does Loopa collect?

The information we collect falls into two categories: Personal Information and Non-Personal Information.

Personal Information is information that can be used to identify, locate, or contact you. Examples of Personal Information we collect include:

  • Contact information such as your name and email address;

  • Profile details such as your birthday and gender;

  • User-generated content such as posts, travel plans, place recommendation pins, accommodation suggestions, and messages;

  • Location information such as GPS coordinates or city-level location; and

  • Payment information processed through our third-party payment providers (we do not store full payment card details).

Non-Personal Information is information that does not identify you as a natural person. Examples include:

  • Cookies and similar tracking technologies used in a non-identifiable way;

  • Aggregated usage statistics and analytics data.

2. Why does Loopa collect this information?

Loopa collects and Processes Personal Information for the following purposes:

  • To create and maintain your account and allow you to interact with the Services;

  • To operate, deliver, and maintain the Services, including social travel matching and place/accommodation recommendation features;

  • To process subscription payments and manage your subscription;

  • To provide customer support, resolve disputes, and troubleshoot technical issues;

  • To measure, analyze, and improve the Services;

  • To comply with applicable laws and regulations, including Quebec's Act respecting the protection of personal information in the private sector (Law 25) and, where applicable, the GDPR; and

  • To communicate offers and updates that may be of interest to you. You may opt out of marketing communications at any time.

We will not use your Personal Information for any purpose not identified in this Policy without first obtaining your consent.

With respect to Non-Personal Information and aggregated data, as this information does not identify any natural person, we may use it for any purpose, including improving our Services, publishing reports, and monitoring trends.

Loopa will not sell, rent, or lease your Personal Information to third parties.

3.Will Loopa share this information with third parties?

To provide the Services, we may share information with third-party service providers (such as cloud hosting providers, payment processors, and analytics tools) who assist us in delivering the Services. These third parties are only permitted to access your information to the extent necessary to perform their specific functions and are required to protect it to at least the same standard we apply.

We may also share information:

  • To comply with legal obligations, including lawful requests from public authorities;

  • To enforce our rights or protect the safety of our users or the public; or

  • In connection with a merger, acquisition, or sale of all or a portion of our assets (with notice to you where required by law).

If we need to share your information for any purpose not listed here, we will obtain your prior consent.

4.How long will Loopa keep my information?

We retain your Personal Information for as long as necessary to fulfill the purposes described in this Policy, or as required by applicable law. When your information is no longer needed, we will securely delete or anonymize it. In general:

  • Account information is retained for the duration of your account and for a reasonable period thereafter for legal and operational purposes;

  • Transaction records are retained as required by Quebec and Canadian tax law; and

  • You may request deletion of your account and associated data at any time (see Section 6).

5. How does Loopa keep my information secure?

We maintain appropriate administrative, technical, and physical security measures designed to protect your Personal Information from unauthorized access, disclosure, alteration, or destruction. These measures take into account the sensitivity of the information and the risks involved in its Processing.

In the event of a security incident involving your Personal Information, we will notify you and, where required, the relevant supervisory authority, in accordance with applicable law (including Law 25 in Quebec).

6.What are my choices with respect to my information?

You always have the choice to limit the information you provide to us.

You may delete your account and associated data at any time directly from the Loopa mobile application. If you experience any difficulty, you may contact us at contact@welkhome.io and we will manually remove all data linked to your account within 7 days.

You may also request to access, correct, or update your Personal Information by logging into your account or by contacting us at contact@welkhome.io.

Loopa does not knowingly collect Personal Information from children aged 16 and under. If you believe a child has provided us with Personal Information, please contact us so we may investigate and delete it.

7.For Quebec and Canadian residents (Law 25)

As a Quebec corporation, Loopa is subject to Quebec's Act respecting the protection of personal information in the private sector, as amended by Law 25 (Bill 64). Under this legislation, you have the following rights:

  • Access: You have the right to know what Personal Information we hold about you and how it is being used.

  • Rectification: You have the right to request correction of any inaccurate or incomplete Personal Information.

  • Erasure: You have the right to request deletion of your Personal Information, subject to our legal retention obligations.

  • Portability: You have the right to receive a copy of your Personal Information in a structured, commonly used, and machine-readable format, and to request its transfer to another organization where technically feasible.

  • Withdrawal of consent: Where Processing is based on your consent, you have the right to withdraw that consent at any time, without affecting the lawfulness of Processing that occurred before the withdrawal.

  • Objection to automated decision-making: If we make decisions about you solely by automated means that produce significant effects, you have the right to be informed and to request human review.

To exercise any of these rights, please contact us at contact@welkhome.io. We will respond within the timeframes required by applicable law. If you believe your privacy rights have been violated, you may file a complaint with the Commission d'accès à l'information (CAI) at www.cai.gouv.qc.ca.

8.For EU/EEA residents (GDPR)

If you are located in the European Union or European Economic Area, you benefit from the rights afforded by the General Data Protection Regulation (GDPR), Articles 15 to 21, including:

  • Access: Request information about what Personal Information we hold and how it is Processed.

  • Rectification: Request correction of inaccurate Personal Information.

  • Erasure: Request deletion of your Personal Information in applicable circumstances.

  • Restriction of Processing: Request that we limit how we Process your Personal Information in certain circumstances.

  • Objection to Processing: Object to Processing based on legitimate interests or for direct marketing purposes.

  • Data Portability: Request a copy of your data in a portable format and, where technically feasible, its direct transfer to another controller.

You also have the right to lodge a complaint with a Data Protection Authority in your country of residence. More information is available at the European Data Protection Board website.

9.For international residents

Loopa is headquartered in Montréal, Quebec, Canada. Your information may be Processed in Canada or in other countries where our service providers operate. We ensure that any international transfer of Personal Information is subject to appropriate safeguards consistent with applicable privacy law, including the requirements of Law 25 and, where applicable, the GDPR.

10.Cookies and tracking technologies

We use cookies and similar tracking technologies to operate and improve the Services. You may control the use of cookies through your browser or device settings. Note that disabling certain cookies may affect the functionality of the Services.

11.Does this Policy ever change?

We may update this Policy from time to time. When we do, we will update the "Last Updated" date at the top of this page. For material changes, we will notify you by email or via an in-app notification. Your continued use of the Services following any change constitutes your acceptance of the updated Policy.
